These Terms of Service ("Terms") govern your access to and use of the Momentum mobile application and related services (the "App") operated by Momentum SAS ("Momentum," "we," "us," or "our"), a company registered in France.
By downloading, installing, creating an account, subscribing to, or using the App, you agree to these Terms. If you do not agree, do not use the App.
## 1. The Service
Momentum is a fitness app that helps users create training plans, track workouts, record sets, count reps, review workout progress, and manage training consistency.
The App may include:
- Account registration and sign-in using Apple or email
- Fitness onboarding and training-plan personalization
- Workout planning and workout logging
- On-device camera-based rep counting and form-related feedback
- Progress tracking, streaks, weekly volume, and workout history
- Subscription paywalls and subscription access management
- Push notifications, if enabled by you
Momentum is not a medical device and does not provide medical advice.
## 2. Eligibility
You must be at least 18 years old to use Momentum. By using the App, you represent that you meet this requirement and that you can legally agree to these Terms.
If you are using the App on behalf of an organization, you represent that you have authority to bind that organization. Otherwise, you may use the App only for personal, non-commercial purposes.
## 3. Account Registration and Security
You may need an account to use Momentum. You are responsible for:
- Providing accurate account and onboarding information
- Keeping your login credentials secure
- Maintaining control of the Apple ID or email account used to sign in
- Promptly notifying us if you believe your account has been compromised
You may not sell, transfer, sublicense, or share access to your account.
## 4. Subscriptions, Billing, and Cancellation
Momentum may require an active paid subscription to access some or all workout features. Subscription products, prices, trial availability, billing periods, and included features are shown in the App and in Apple's purchase sheet before you buy.
### Apple In-App Purchase
Subscriptions are purchased through Apple In-App Purchase and are billed to your Apple Account. Apple processes payments, renewals, cancellations, and refund requests under Apple's terms.
### Auto-Renewal
If you purchase an auto-renewable subscription:
- Your subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period.
- Your Apple Account may be charged within 24 hours before the end of the current billing period.
- You can manage or cancel subscriptions in your Apple Account subscription settings.
- Deleting the App does not cancel your subscription.
### Trials and Promotions
If a free trial or promotional offer is available, the terms shown in the App and Apple's purchase sheet apply. Unless cancelled before the trial ends, a trial may convert into a paid subscription.
### Refunds
Refunds for Apple In-App Purchases are handled by Apple. To request a refund, use Apple's refund process at https://reportaproblem.apple.com.
## 5. Health and Fitness Disclaimer
Momentum provides fitness tracking, general training guidance, and workout-support tools. It is not a substitute for professional medical advice, diagnosis, treatment, physical therapy, or individualized personal training.
You understand and agree that:
- Exercise involves risk, including injury, overexertion, and aggravation of existing conditions.
- You should consult a physician before beginning or changing an exercise program, especially if you have a medical condition, injury, pain, pregnancy, or other health concern.
- You are responsible for choosing exercises, weights, intensity, and technique appropriate for your condition and environment.
- You should stop exercising immediately if you experience pain, dizziness, shortness of breath, faintness, or unusual discomfort.
- Rep counts, form feedback, camera guidance, and training recommendations may be inaccurate or incomplete.
- Momentum does not guarantee any fitness, body-composition, strength, aesthetic, or health outcome.
You use the App and perform workouts at your own risk.
## 6. Camera and Computer Vision Features
Momentum may use your device camera to count reps and support form-related feedback. Camera-based features depend on lighting, camera placement, exercise type, body visibility, device performance, and other factors.
You agree that:
- Camera-based rep counting is an estimate and may require manual correction.
- Form-related feedback is informational only and may not identify all risks or technique issues.
- You should not rely on Momentum as your only source of safety guidance.
- You are responsible for maintaining a safe workout environment.
## 7. Your Content and Data
You retain your rights in the personal information and workout data you provide to the App. You grant Momentum a limited right to process that information to provide, maintain, secure, and improve the App as described in our Privacy Policy.
You are responsible for information you enter into the App and for ensuring that you have the right to provide it.
## 8. Acceptable Use
You agree not to:
- Use the App for unlawful, harmful, fraudulent, or abusive purposes
- Interfere with, overload, or disrupt the App or its servers
- Attempt to bypass authentication, App Attest, paywalls, rate limits, or security controls
- Reverse engineer, decompile, modify, or create derivative works from the App except where law allows
- Scrape, crawl, automate, or bulk access the App without written permission
- Upload malicious code or attempt to compromise other users, the App, or our providers
- Misrepresent your identity or subscription status
- Use the App to provide commercial training services without written permission
We may suspend or terminate access if we believe you violated these Terms or created risk for Momentum, users, or third parties.
## 9. Intellectual Property
The App, software, design, branding, text, graphics, training-plan logic, coaching content, and related materials are owned by Momentum or its licensors and are protected by intellectual-property laws.
Subject to your compliance with these Terms, Momentum grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for personal fitness tracking and training support.
No rights are granted except as expressly stated in these Terms.
## 10. Third-Party Services
The App relies on third-party services, including Apple, Supabase, Fly.io, Cloudflare, Adapty, OneSignal, Bugsnag, and Mixpanel. Third-party services may be subject to their own terms and privacy policies.
We are not responsible for third-party services except to the extent required by applicable law.
## 11. Apple Terms
When you download the App from the Apple App Store, Apple's terms, including the Apple Media Services Terms and Apple's Standard End User License Agreement, may also apply unless we configure a custom EULA in App Store Connect. If these Terms conflict with mandatory Apple terms, Apple's terms control only to the extent of the conflict.
Apple is not responsible for providing maintenance or support for the App.
If these Terms are treated as a custom end-user license agreement for App Store purposes:
- These Terms are between you and Momentum, not Apple.
- Momentum, not Apple, is responsible for the App and its content.
- Your license is limited to a non-transferable right to use the App on Apple-branded devices that you own or control, as permitted by Apple's usage rules.
- Momentum is responsible for support, maintenance, product claims, and intellectual-property claims related to the App to the extent required by applicable law.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
## 12. Updates and Changes to the App
We may update, modify, suspend, or discontinue parts of the App at any time. We may add or remove features, change workout logic, modify supported exercises, or change subscription offerings.
If a change materially affects your paid subscription rights, we will handle it as required by applicable law and Apple rules.
## 13. Termination
You may stop using the App at any time. You may request account deletion through the App, if available, or by contacting **support@getsmomentum.com**.
We may suspend or terminate your access if you violate these Terms, if required by law, if your subscription expires, or if continued access creates risk for Momentum, users, or third parties.
Account deletion does not automatically cancel an Apple subscription. You must cancel subscriptions through your Apple Account.
## 14. Disclaimers
To the maximum extent permitted by law, the App is provided "as is" and "as available." We disclaim all warranties, whether express, implied, or statutory, including warranties of fitness for a particular purpose, merchantability, non-infringement, accuracy, availability, and uninterrupted operation.
Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
## 15. Limitation of Liability
To the maximum extent permitted by law, Momentum and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, personal injury, or loss of goodwill, arising from or related to your use of the App.
To the maximum extent permitted by law, Momentum's total liability for claims related to the App will not exceed the greater of:
- The amount you paid to Momentum through the App in the 12 months before the claim, or
- EUR 100.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, intentional misconduct, or rights you may have under mandatory consumer protection laws.
## 16. Indemnity
To the extent permitted by law, you agree to indemnify and hold Momentum harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the App, violation of these Terms, violation of law, or infringement of third-party rights.
## 17. Governing Law and Disputes
These Terms are governed by the laws of France, except for conflict-of-law rules.
If you are a consumer in the European Union, this does not deprive you of mandatory consumer protections in your country of residence.
Courts located in Paris, France will have jurisdiction, except where applicable consumer law gives you the right to bring claims elsewhere.
## 18. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the App, by email, or by another appropriate method. The "Last updated" date shows when these Terms were last revised.
Your continued use of the App after changes become effective means you accept the updated Terms.
